SUSPENSION OF BONDING PRIVILEGE FOR NEW SHIPPERS

The Department of Commerce implements the temporary suspension of the new shipper bonding provision in accordance with the Pension Protection Act, which was signed into law on August 17, 2006. This legislation affects entries of subject merchandise from new shippers during the period April 1, 2006, through June 30, 2009.

1. On 08/17/2006, the Pension Protection Ace of 2006 (H.R.4) was signed into law. Section 1632 of H.R.4 (Suspension of New Shipper Review Provision) temporarily suspends the authority of the U.S. Department of Commerce(Commerce) to instruct U.S. Customs and Border Protection (CBP) to collect a bond or other security in lieu of a cash deposit of estimated antidumping and countervailing duties for each entry of subject merchandise during the period 04/01/2006, through 06/30/2009.

2. The following instruction does not apply to goods from Canada or Mexico, in accordance with 19 U.S.C. Section 3438.

3. For all new shipper reviews, except as indicated above, Commerce conducts during the pendency of this temporary period, CBP shall no Longer collect bonds or other security in lieu of a cash deposit of estimated antidumping and countervailing duties.

4. Effective 08/17/2006, for all new shipper reviews, except as indicated above, CBP must collect a cash deposit of estimated antidumping and countervailing duties on each entry of subject merchandise entered, or withdrawn from warehouse, for consumption.

5. Further, CBP shall collect a cash deposit of estimated antidumping and countervailing duties from importers on each entry of merchandise made during the conduct of all new shipper reviews, except as indicated above, entered or withdrawn from warehouse for consumption on or after 04/01/2006, for which a bond was collected as security.

6.
